Ripple's CEO Slams SEC Chair Gensler Over What's a Security The CEO of Ripple Labs, Brad Garlinghouse, has criticized the chairman of the U.S. Securities and Exchange Commission (SEC), Gary Gensler, for dictating which crypto tokens are securities. Garlinghouse tweeted Thursday: For the Chair of the SEC to assert that he dictates what is a security — and not the legislation from which his agency derives its power — is beyond comprehension. It's time for elected officials in the U.S. to take notice. "When you behave like an autocrat running a $2.2B bloated agency, why would you ever want to provide clarity about what's 'in or out'? Without clear jurisdiction, ambiguity masquerades as power," Garlinghouse cautioned. The Ripple executive made this statement in reaction to Gensler's claim that the current securities laws "cover most of the activity that's happening in the crypto markets." The SEC chief was quoted as saying: "If Congress were to act, though I don't think we need these authorities, not to undermine inadvertently through definitions of what's in or out, or in essence allowing for conflicts that we don't allow." Gensler warned: I think many of the legislative vehicles would, if adopted, undermine the securities remit. Since the SEC filed a lawsuit against Ripple, Garlinghouse, and co-founder Chris Larsen in December 2020, the company has been embroiled in a legal dispute with the securities regulator. The SEC claimed that XRP is a security, but Ripple and Garlinghouse have consistently argued that it is not. On several occasions, Gensler has emphasized the importance of cryptocurrency exchanges and lending platforms coming in to discuss how to be compliant with the SEC. However, Garlinghouse has accused the securities watchdog of holding meetings with crypto companies primarily for the purpose of generating leads for its Enforcement Division. There have also been widespread complaints that the SEC does not provide clear regulatory guidelines, making it difficult for companies in the crypto space to ensure compliance. Recently, the Nasdaq-listed crypto exchange Coinbase received a Wells notice from the SEC regarding potential violations of the securities law. The company noted in its response: "The SEC will not let crypto companies 'come in and register' — we tried." Meanwhile, Gensler has repeatedly expressed the view that all crypto tokens, apart from bitcoin, are considered securities. However, the cryptocurrency retracted and returned to trading within its range formed in the last week between $27,600 and $28,500.  Despite this choppy price action, a recent blog post by Justin Bennett, trader and analyst of the crypto market suggests that BTC has established "strong" horizontal levels, which are favorable for both scalpers and investors who prefer this period of range or consolidation in the market. Will These Horizontal Levels Hold A Potential Decline In BTC's Price? Bennett further mentions that Bitcoin trades above the $28,130 pivot point on an hourly and 4-hour closing basis. Any attempt to retest this level will likely attract sellers, potentially triggering another run at the $27,650 support floor and potentially lower prices.  Bitcoin's horizontal levels. Source: Justin Bennett Blog Although the horizontal levels seen in the chart may provide opportunities for scalping, Bennett cautions that there is a potential downside risk if BTC's support levels are breached.  Bennett suggests that while BTC's price has no confirmed direction, there are currently more long liquidations below the price than short liquidations above. Source: Justin Bennett Blog However, with Bitcoin trading above the key pivot point, there is still potential for further upside and consolidation above the $29,000 level. The $28,900 macro resistance level is the next target for BTC, and a successful breach could lead to further gains for the largest cryptocurrency in the market. Bennett further suggests that the primary range for Bitcoin is between $26,500 support and the $28,900 resistance wall, with smaller ranges within this range. This can result in the price movement may be relatively stable within this range. Still, there is a potential for significant volatility if the price breaks out of this range and experiences a correction toward the support level.  A New Cycle Is Just Beginning For Bitcoin According to Rekt Capital, with the closure of Q1 for Bitcoin and the broader cryptocurrency market, BTC is on the verge of confirming its first bullish quarterly engulfing candle since early 2020. This pattern occurs when the opening price of a particular quarter is lower than the closing price of the previous quarter.  According to Rekt, this pattern has historically preceded multiple quarters of upside for Bitcoin, meaning that BTC's price tends to increase for several quarters after the pattern is confirmed, like in the bull market of 2021.  Bitcoin's engulfing candles. Even if Bitcoin's price experiences a pullback in the near term, the sentiment of the cryptocurrency market seems to aim for one thing: BTC is poised for a new bull run.  The market is expected to undergo a sustained period of price increases in the coming months, with the first quarter closing above key levels. This information alone should raise a red flag, especially in light of Bitcoin's price decline from $39,000 to less than $25,000 during the same period. Traders seeking to leverage their cryptocurrency position had borrowed over 105,000 Bitcoin. Currently, the cause of this anomaly is unknown, as well as the number of entities involved in the trade. Cheap borrowing favors high demand Bitfinex's sub-0.1% annual rate may be a contributing factor to the size of the Bitcoin lending market. To date, this has been the norm and it creates enormous incentives for borrowing, even if there is no current need. There are few traders who would turn down such a ridiculously inexpensive leverage opportunity. Margin borrowing can be used to take advantage of arbitrage opportunities, where a trader exploits price discrepancies between different markets. For example, borrowing Bitcoin on margin allows a trader to take a long position in one market and a short in another, profiting from the price difference. To understand how Bitcoin borrowing can be used to profit on derivatives markets, including those outside of Bitfinex, one must understand the distinction between futures contracts and margin markets. The margin is not a derivative contract, so the trade occurs on the same order book as spot trading. In addition, unlike futures, margin longs and shorts are not always in balance. For example, after purchasing 10 Bitcoin using margin, the coins can be withdrawn from the exchange. Naturally, the trade, which is typically based on stablecoins, requires some form of collateral or a margin deposit. If the borrower fails to return the position, the exchange will liquidate the margin in order to repay the lender. Additionally, the borrower must pay interest on the BTC acquired with a margin. The operational procedures vary between centralized and decentralized exchanges, but the lender typically determines the interest rate and duration of offers. There was a 12,000 BTC margin decline in a single trade Historically, Bitfinex margin traders have been known to move large margin positions quickly, indicating the participation of whales and large arbitrage desks. Source: TradingView Notice how significant the decrease was, despite the fact that it had no effect on the Bitcoin price. This supports the theory that such margin trades are market-neutral because the borrower is not leveraging their positions with the proceeds. Most likely, there is some arbitrage involving derivatives instruments. Traders should cross-reference the data with other exchanges to confirm that the anomaly affects the entire market, given that each exchange has distinct risks, norms, liquidity and availability. OKX, for example, provides an indicator for margin lending based on the stablecoin/BTC ratio. Traders can increase their exposure on OKX by borrowing stablecoins to purchase Bitcoin. Source: OKX The above chart shows that OKX traders' margin lending ratio has been stable for the past week near 30, indicating that professional traders' long-to-short bets have not changed. This data supports the theory that Bitfinex's decline is due to an arbitrage close unrelated to Bitcoin price movement. Crypto clients were told to close their accounts by April, according to a Bloomberg report. While New York Community Bancorp (NYCB) purchased the majority of Signature Bank's deposits and loans on March 19, the deal with the FDIC did not include crypto-related accounts. If those whales are forced to close their banking accounts, they will most likely reduce their arbitrage positions, including those in margin markets. For the time being, all assumptions are speculative, but one thing is certain: the 12,000 BTC long margin reduction at Bitfinex had no effect on Bitcoin prices. XLM looks equally bullish versus the U.S. dollar The Stellar price rallied more than 25% in March to reach $0.113, its highest level in four months. XLM is now positioned for a potential short-term price correction in the first week of April, followed by a rebound rally to new yearly highs. At the core of this bullish outlook is a classic technical pattern dubbed cup-and-handle. The pattern forms when the price undergoes a U-shaped recovery, or cup, followed by a consolidation period, i.e., the handle, all under a common resistance level called "neckline." Meanwhile, it resolves after the price breaks above the neckline and rises by as much as the distance between the cup's bottom and neckline. Notably, XLM has been painting a similar cup-and-handle since November 2022. XLM/USD entered the pattern's breakout stage during its price boom in March, and is now 20% away from reaching the breakout target near $0.131. XLM/USD daily price chart. So the breakout scenario will be confirmed when the price bounces from the neckline, accompanied by a rise in trading volumes. Though Krüger mentioned the statement was a social experiment to observe engagement in response to a polarizing absolute statement, he still stood on his words saying "what I wrote still holds true. People shouldn't be buying Bitcoin to get rich any longer." According to Krüger, BTC is no longer an asset to buy as an investment as the asset has advanced away from that category and is now more of a store of value. The crypto analyst noted, "That [Bitcoin] boat has sailed. Bitcoin is now for wealth preservation, attractive risk-adjusted returns, trading, and hedging against the fiat system." When another user commented on the analyst's post expressing his opinion that Bitcoin still has the potential to 10x, especially from the $15,500 region, the analyst replied saying a 10x from the lows "seems feasible." However, not so much from the current market prices. Analyst Advice Instead Of Bagging BTC While Krüger tweeted his sentiment about Bitcoin, the analyst hinted at some advice investors should heed instead of bagging BTC. According to Krüger, investors should focus more on bagging crypto assets that are more volatile than BTC. Krüger noted: The best way to increase returns is not to trade with higher leverage, but to trade assets with higher volatility. Less liquid caps are more volatile. Microcaps are the most volatile. The analyst further added if he was just starting out, he'd focus will be solely on decentralized finance (DeFi) microcaps as "it's much easier to do 100x on a small account with microcaps than with levered BTC trading." The analyst also said:  If I were starting again, I'd focus entirely on DeFi microcaps. At 8:00 am UTC (4:00 am EST), Deribit, the world's largest crypto options exchange by trading volume and open interest, settled over $4 billion worth of Bitcoin options. The Bitcoin price fell below $28,000 on this occasion, recording a low of $27,512. Pseudonymous analyst @52kskew stated that Deribit-driven selling occurred. However, decent supply support has been seen on Bitstamp and several other exchanges. The analyst shared the chart below and added: Deribit CVD & Delta showing the price impact of option expiry. The PCE is the Federal Reserve's preferred inflation metric. This second major event is now also on the books. In an initial reaction, the Bitcoin and crypto markets reacted positively to the new inflation data. The US Bureau of Economic Analysis (BEA) announced that the annual rate of the core PCE price index was 4.6% in February, while the expectation as well as the previous reading was 4.7%. This, Core PCE services excluding housing had the smallest increase in February since last July. The Core PCE rate on a monthly basis was reported at 0.3%, with the forecast at 0.4% and last reported as high as 0.6%. In addition, US personal spending in February (MoM) was also reported at 0.2% (estimate 0.3%, prior 2.0%). Because of this, the Bitcoin price is also currently reacting bullish to the news. However, the reaction is muted. While inflation is slowing, which is good for the financial markets, the economy is also slowing as shown by personal spending, which is bad and fuels fears of a recession. Moreover, the slowdown in inflation cannot be considered good enough. 5% PCE and 4.6% core inflation are still far from a stable 2%. As stated in the report, the passage of the bill by the legislative body's Political Affairs Committee has raised hopes that the South Korean legislators will finally pass the law after several failed attempts. South Korea's prospects for finally passing a law that governs digital assets were raised after Rep. Kim Hee-gon, a member of the Political Affairs Committee's first subcommittee, revealed that opposition and ruling party members had narrowed their differences. "On March 28th, the 1st subcommittee sorted out the issues of the bills and narrowed the differences between the members, so it is expected that the bill will be passed in April," Hee-gon reportedly said. In addition, the Greenpeace-commissioned Bitcoin Skull caused a stir as part of the "Change the Code, not the Climate" initiative. However, Greenpeace's action backfired when climate activist and artist Von Wong expressed that he himself was no longer convinced by the Greenpeace campaign. "I made the Skull believing that Bitcoin mining was a simple black-and-white issue. I've spent my entire career trying to reduce real-world physical waste, and PoW felt intuitively wasteful. Of course, I was wrong. Few things in the world are black and white. Dumb me," von Wong wrote on Twitter after engaging with the Bitcoin community. Will Greenpeace Rethink Bitcoin? If Greenpeace has integrity and is not driven by its dubious donors, the organization would have to cancel its campaign and even endorse Bitcoin. Bitcoin and climate activist Daniel Batten has released a new research showing that BTC's main source of energy is hydropower, accounting for 23% of its total energy. Fossil fuel sources have declined by a total of 6.2% per year since January 2020. "Surprising fact: Bitcoin mining the only major global industry who's major energy source is not a fossil fuel. The major power source for the global grid is coal (36.7%)," Batten wrote in a tweet. With his research, Batten has thus refuted an oft-postulated claim by the Cambridge Centre for Alternative Finance (CCAF) that coal is the main power source used by the BTC network. Unlike CCAF, Batten included off-grid mining in his investigation, providing a complete picture of the Bitcoin network. The most important source of energy is hydropower (23%), followed by coal, gas, and wind. Bitcoin mining energy sources | Source: Batten found that off-grid generated 15.8% of its electricity from hydropower, but more than half of sustainable off-grid mining is powered by hydro. Sustainable mining companies such as OceanFalls, Blockfusion, Hut8, Iris, Sato, Terawulf, Statar/Lake Parime, Gridshare, and HPG are examples of companies that are either 100% or predominantly powered by hydropower, according to the Bitcoin activist. The second largest sustainable energy source is wind power, which now accounts for nearly 14% of total Bitcoin mining electricity. "Companies such as Marathon, with 14 EH of hashrate, the heavy component of which is behind-the-meter wind farms, contribute to this strong showing," Batten said. In addition, the high 25% of wind power on the Electric Reliability Council of Texas (ERCOT) grid is another factor in wind power's strong showing, he said. On the topic of coal and mining, Batten found that Bitcoin, like eVs, is a fully electrified technology with zero direct emissions. The emissions come from the use of electricity, some of which is generated with fossil fuels. In comparison, Bitcoin mining actually performs better. Assuming that eVs are proportionally distributed around the world and use the global grid mix, one would have to assume that coal is the main source at 36.7%, followed by gas at 23.5%. Compared to eVs, Bitcoin mining uses a similar proportion of gas (21.14%) but a significantly lower use of coal as an energy source (22.92%): 38% less than eVs. Looking ahead, Batten explained that the BEEST model suggests that the sustainable mix of the BTC network is currently growing at 6.2% per year. If this growth continues, it will cause the relative shares of coal, gas, and other fossil fuel sources to continue to decline. In addition, Bitcoin could help shape the energy transition because mining systems can be turned on and off very flexibly, acting as spontaneous consumers of surplus production. They could therefore be used not only to better manage the utilization of energy grids, but also to make renewable energy more quickly profitable through BTC-induced cross-financing. In a recent Twitter space, Batten remarked about Greenpeace: This will be a great surprise that the action not only has worked but there's actually a counter attack. They are now subject to the same scrutiny that they are typically keeping people accountable to. So this will be new for them. At press time, the BTC price stood at $ 28,030. Additionally, the regulator alleged that the cryptocurrency exchange's founder raised $8 million in an unregistered crypto token offering and "misappropriated at least $900,000 for personal use, including gambling." SEC Charges Crypto Exchange Platform Beaxy The U.S. Securities and Exchange Commission (SEC) announced Wednesday that it has filed charges against crypto asset trading platform Beaxy, its founder, and its executives. SEC Chairman Gary Gensler commented: We allege that Beaxy and its affiliates performed the functions of an exchange, broker, clearing agency, and dealer without registering with the Commission and complying with clear, time-tested rules governing those activities. Besides alleging that Beaxy and its executives failed to "register as a national securities exchange, broker, and clearing agency," the securities watchdog said that it has "charged the founder of the platform, Artak Hamazaspyan, and a company he controlled, Beaxy Digital Ltd., with raising $8 million in an unregistered offering of the Beaxy token (BXY)." The SEC "alleged that Hamazaspyan misappropriated at least $900,000 for personal use, including gambling." The regulator also "charged market makers operating on the Beaxy Platform as unregistered dealers." In its complaint, the SEC claimed that Nicholas Murphy and Randolph Bay Abbot have been operating the Beaxy Platform since October 2019 through their management of Windy Inc. The SEC noted that the pair convinced Hamazaspyan to resign following the BXY offering. Beaxy Shuts Down Following the SEC enforcement action, Beaxy announced on its website: "Regrettably, we are announcing the immediate suspension of services on Beaxy Exchange. Due to the uncertain regulatory environment surrounding our business, we have made the difficult decision to cease operations." While emphasizing, "We forthrightly committed to cooperation with the Securities and Exchange Commission (SEC) for over two years, continually providing information, data, and interviews to assist regulators in whatever manner we could," the company stressed: Unfortunately, despite our best efforts, it has become clear that the regulatory environment is just too uncertain to continue operations.
