The latest online hackathon is expected to serve as an initial step in the process. Toyota – Astar Web3 Hackathon As part of the event, developers from around the world are invited. The theme will be to build an intra-company DAO support tool on the Astar Network to enable anyone to create teams, issue governance tokens, and vote without requiring them to understand the details of Web3. While the multinational automotive manufacturer could use the tools developed during the hackathon for operational transparency and efficiency purposes. Astar Network, on the other hand, will offer the necessary environment for devs and will be tasked with product development support. The move comes amid a recent resurgence in NFT trading volume after a lull that was part of a broader downturn in crypto activity. SUDO Tokens to Be Airdropped to SudoSwap LPs SudoSwap announced the launch of its SUDO token on Monday, Jan. 30. The token release, updated earlier today, included an airdrop for early supporters of the project. The SUDO airdrop will reward liquidity providers (LPs) on the platform. SudoSwap is a different kind of NFT marketplace from the likes of OpenSea. It resembles more of an automated market-making platform like Uniswap but for NFTs. SudoSwap enables the creation of liquidity pools for NFTs. As such, there are liquidity providers, users who supply liquidity in the form of NFTs and crypto tokens to enable trading, and the airdrop is designed to reward them. LPs are not the only ones who will benefit from the airdrop, as XMON holders can qualify for the airdrop as well. XMON is the native token of the 0xmons ecosystem, which was created by the SudoSwap founders, and it includes an NFT collection. XMON holders can lock their tokens for one month to receive the SUDO airdrop. Those who do so will receive 10,000 SUDO tokens for every XMON coin locked, according to the announcement. The senators suspect that Silvergate may have played a role in illegally transmitting FTX user funds to Alameda Research through the trading firm's accounts with the bank.  Silvergate and FTX According to BNN Bloomberg, the senators sent a letter to Silvergate on Monday questioning the bank over its ties to FTX. The bipartisan group includes Democrat Elizabeth Warren – a renowned crypto skeptic – and Republicans Roger Marshall and John Kennedy. Within the letter, the politicians said Silvergate had declined to answer similar questions in December due to "confidential supervisory information." For the senators, this justification was unacceptable.  "This is simply not an acceptable rationale," the senators wrote back to Silvergate Chief Executive Officer Alan Lane. "Both Congress and the public need and deserve the information necessary to understand Silvergate's role in FTX's fraudulent collapse, particularly given the fact that Silvergate turned to the Federal Home Loan Bank as its lender of last resort in 2022." Yet Silvergate may not be out of line: Sultan Meghji, former chief innovation officer for the Federal Deposit Insurance Corp, said banks could be held criminally liable for disclosing confidential supervisory information  He said Congress ought to work with regulators to find the information it desires, finding Silvergate's reluctance to open up in this situation "not surprising." During its previous question period, Silvergate said it opened an account with Alameda back in 2018, which was before FTX's founding. It also claimed to have conducted ongoing due diligence checks on both Alameda and FTX while it worked with the companies.  The senators' Monday letter asked for details on Silvergate's due diligence practices, and results of the Federal Reserve's annual examinations and other independent audits.  Kevin O'Leary, a previous spokesperson for FTX, has said that he and other investors "relied on each other's due diligence" when getting involved with the company, and that they feel foolish in hindsight.  Silvergate After FTX When FTX filed for bankruptcy in November, its collapse sent shockwaves throughout the market impacting numerous major firms, including both BlockFi and Genesis. Silvergate claimed its deposit relationship with BlockFi was less than $20 million, and that it hadn't invested in the company.  But that doesn't mean Silvergate isn't feeling the heat: the bank announced a 40% staff layoff in early January while scrapping its planned $196 million purchase of Facebook's collapsed stablecoin project, Diem. It disclosed a $1 billion net loss in Q4 2022.  Silvergate is the bank that MicroStrategy worked with to take out a $205 million Bitcoin collateralized loan in March of last year. Bitcoin fell over 50% since that time and forced MicroStrategy to post more collateral to prevent liquidation. In a filing, Pillay stated that the bankrupt crypto firm conducted its business in a starkly different manner than how it marketed itself to its customers in every key respect. The report claimed that Celsius lacked a sufficient risk management function and was unable to track its financial position or evaluate profitability. It also stated that Celsius and its founder Alex Mashinsky, who is currently facing fraud allegations in the United States, failed to deliver on the lavish promises. Very Ponzi-Like Operations The examiner interviewed Celsius employees, including former chief Executive Officer Alex Mashinsky, as well as customers and vendors to the company to address whether it operated a Ponzi scheme. Pillai stated that Celsius inflated its native token CEL's price "to get the valuations to be able to sell back to the company." Celsius acknowledged that customer funds should not be touched to purchase the coins necessary to cover liabilities to other clients. It still went on to use customer deposits to fill the billion-dollar hole in its balance sheet. The company's justification was that it was posting the customer deposits as collateral to borrow the necessary coins instead of selling them. The proceeds were then used to continue the purchasing of CEL. In April 2022, Celsius's Coin Deployment Specialist Dean Tappen himself described the company's practice of "using customer stablecoins" and "growing short in customer coins" to buy CEL as "very Ponzi-like." Pillay also asserted that the employees were aware of fund discrepancies but chose to stay silent about it. Additionally, Celsius never liquidated any of its CEL to address its liquidity needs, even as it scrambled to find liquid assets leading to June 12, 2022, when it paused all customer withdrawals. While speaking about Mashinsky, a manager of the company was even quoted saying, "we spent all our cash paying execs and trying to prop up alexs [sic] net worth in CEL token." Who's Coins? Mashinsky, on several occasions, represented to its current and prospective customers that crypto assets belonged to them and not Celsius using phrases such as "your coins," "my coins," or "your crypto." The exec completely backtracked while being interviewed by the examiner. Instead, he stated, "100% of the actions are our actions, (the customer) can't take any action (themselves) on the platform." Pillai further stated that Celsius made efforts to later edit some of the erroneous information out of the recorded AMA videos. However, it did not retract or otherwise correct any inaccurate or misleading statements made during AMAs viewed live or before any edits were implemented. The non-ministerial department asserted that trustees submitted an RSI and sufficiently performed their duties and responsibilities. While trustees have not been involved in any wrongdoing, the Charity Commission did point out indications of potential risks to the charity's assets. The commission also said that the inquiry was launched to establish facts and help ensure the trustees protect the charity's assets. It also sought to confirm if the operations are in line with their duties and responsibilities. The inquiry is set to focus on the extent of any risk to the charity's assets. The extent to which the trustees are complying with their legal duties in terms of the protection of their property is also under scrutiny. It will examine the governance and administration of the charity by the trustees. This includes relationships between the organization's trustees and its funders. Conflicts of interest identification and management of and/or loyalty will also be analyzed. "The Commission may extend the scope of the inquiry if additional regulatory issues emerge. It is the Commission's normal policy after it has concluded an inquiry, to publish a report detailing the issues examined, the action undertaken, and the inquiry's outcomes." The inquiry was opened on December 19 after FTX filed for Chapter 11 bankruptcy in the US while its former CEO Sam Bankman-Fried was arrested in the Bahamas. That's a big deal for the southeast island nation, whose $35 billion remittance market is comprised of $12 billion from the U.S. alone.  Empowering the service is Bitcoin's lightning network – a layer two scaling solution allowing instant peer to peer Bitcoin transfers for fractions of a penny. The lightning network's capacity and adoption has climbed substantially over time, now supported by over 16,000 nodes and 76,390 open channels.  Jack Mallers – CEO of Strike – has frequently praised the lightning network as a more efficient and less exploitative tool for remitting value to the global south, as opposed to existing alternatives like Western Union.  "Remittances are a broken system and Strike delivers an incredibly empowering experience for people to send money around the world in nearly an instant," said Mallers in a statement. "Our technology allows us to both improve on the existing cross-border experience and include those that have previously been excluded by legacy payment rails." Supporting Strike's Send Globally feature in the Philippines is Pouch.ph, a Bitcoin company supporting peso payments over Bitcoin's lightning network. Together with Strike, a U.S. person sending U.S. dollars can have their funds transferred over lightning, converted into pesos, and deposited into a Filipino bank account or mobile money account.  Strike previously partnered with the African Bitcoin company Bitknob to bring lightning remittances to Nigeria, Kenya, and Ghana – the former of which already has a 35% crypto adoption rate, according to a KuCoin study. While Strike is focused on expanding internationally, it has prioritized countries in greatest need of better remittance technology, such as El Salvador and Argentina.  Strike's Plans at Home Strike has big ambitions within U.S. borders as well – including bringing lightning network compatibility to major merchant providers across the country. The ruling came during an appeal hearing on January 30, 2023, settling an agelong debate between the SEC and the crypto community. Judge Clarifies Ruling in LBRY v. SEC Case The court initially ruled in favor of the SEC in November 2022, granting the commission's request for a summary judgment filed in May 2021. CryptoPotato reported that the SEC sued LBRY in March 2021, alleging that the platform was selling its native token LBRY Credit (LBC), as an unregistered security. The agency argued that the blockchain platform raised over $11 million in crypto and cash from investors from 2016 to 2021. The regulator found the sale of the LBC tokens as an investment contract and classified it as a security. However, LBRY insisted that LBC was not a security as millions of people were active on the platform before any tokens were issued. The project also noted that it held no initial coin offering (ICO). During the appeal hearing yesterday, the SEC asked the judge to clarify the first ruling, as it looked to prohibit the sale of LBC. Interestingly, the tides changed as the judge explained that the injunction only applied to direct token sales. Notably, the ruling was greatly influenced by the efforts of attorney John Deaton, who was present as an amicus curiae. A Potential Win for Ripple? Deaton cited a paper by attorney Lewis Cohen, which evaluated all security lawsuits that have emerged in the U.S. since the creation of the Howey Test. The documents revealed that no court acknowledged an underlying asset as a security. As Deaton's persuasion broke the surface, the judge turned to him and said: "Amicus, I'm going to make it clear that my order does not apply to secondary market sales." The 'Strategic Investment' According to a document seen by CryptoPotato, VVF's financing aims to support the Web3 industry by solving its scalability issues. It should also help Everscale complete its goal of hiring more developers and increasing the number of projects. The $5 million investments will be sent in stages, depending on the progress and other indicators. Everscale has already displayed intentions to expand its global presence. Its particular goal is to integrate its blockchain solutions in Asia and establish a strong community in the region. Speaking on the matter was Peter Knez – VVF's Chairman and former CIO of BlackRock: "For us, this is a strategic investment aimed at the technological development of projects and teams around technologies that we focus on and actively develop. In particular, we are talking about the Venom blockchain project and its ecosystem, which is planned to be launched soon and for which Everscale is a potential Layer 2 solution." Moon Young Lee – Everscale Foundation Board Member – described the investment as a "milestone" for the two entities.  "The technological capabilities of Everscale are immense, but they have been underappreciated by a wider audience. Now, Everscale will be able to operate as an experimental network where updates and complex technical solutions can be introduced before they are brought to Venom. This investment will allow Everscale to gain the recognition that it deserves," he added. The Launch of the Fund Venom Foundation and Iceberg Capital joined forces mid-January to introduce the $1 billion venture fund VVF. Its mission is to invest in Web3 dApps, blockchain projects, innovative protocols, Decentralized Finance (DeFi), and GemeFi.  Venom Ventures Fund relies on Iceberg Capital's network and expertise to offer access to various incubation programs. It also provides investors with marketing, technical, legal, and regulatory support. Mustafa Kheriba – Executive Chairman of Iceberg Capital – said his organization is "thrilled" to partner with Venom Foundation on the launch of the fund. He opined that crypto participants should not be concerned about the market decline but "build and innovate" during the challenging times.  VVF made its first steps in the investment field, leading Nümi's $20 million funding round. Djed is developed jointly by the layer 1 blockchain network, COTI, and Input-Output Global (IOG), the blockchain-engineering company behind Cardano. Currently, the stablecoin is also available on Cardano-based decentralized exchanges (DEXes) such as  MinSwap, Wingriders, and MuslieSwap and will be expanded on other top platforms in the Cardano ecosystem. Bitrue announced plans to list DJED as well as the reserve token SHEN. As explained earlier, Djed works on a mechanism of over-collateralization by 400%-800% with on-chain proof of reserves to preserve its value in volatile market conditions. Djed is pegged to the USD and backed by Cardano's native asset, ADA. SHEN, on the other hand, is designed to support the stability of the newly-launched stablecoin. His trial date is set for October 2, 2023. According to a report by Reuters, Judge Kaplan ruled in favor of many media outlets, such as Bloomberg, CNBC, and The Washington Post, who insisted that the identity of those people should be disclosed. The names will remain under seal until at least February 7 because "the question presented here is novel and an appeal is likely," the magistrate outlined. After spending a brief time in a Bahamian jail, the authorities extradited Bankman-Fried to the US, where he was expected to see the prison cell from the inside. However, a New York federal judge ordered that he could live at his parents' house under a $250 million bond. The 30-year-old must wear an electronic monitoring bracelet and is not allowed to leave the Northern District of California. His attorneys previously declined to reveal the names of the sureties that enabled the bond, arguing they will suffer similar harassment as his parents. The lawyers claimed that Ms. Fried and Mr. Bankman have recently received "a steady stream of threatening correspondence, including communications expressing a desire that they suffer physical harm." In addition, three mysterious men drove their vehicle into a metal barricade outside their house in California. Bitcoin Below $23K As CryptoPotato reported earlier today, January 2023 is en route to becoming the asset's best-performing month in over a year. This is because BTC stood below $17,000 at the start of the year and has skyrocketed by roughly 40% in the following 31 days. It was even higher yesterday when the bulls initiated another impressive leg-up that resulted in coming inches away from $24,000. This became BTC's highest price point since mid-August 2022. However, the bears were quick to remind of their presence and pushed bitcoin south almost immediately. In the following hours, the cryptocurrency fell to $23,000 and kept plunging to an intraday low of $22,400 (on Bitstamp). Despite recovering some ground since then, BTC still struggles below $23,000. Its market cap is down to $440 billion, and its dominance over the alts has taken a minor hit and is now at 42.4%. BTCUSD. Ethereum went well above $1,600 during the weekend, but two consecutive days of price drops have pushed it to $1,570 as of now. Ripple, Cardano, Polygon, OKB, Solana, Polkadot, and Avalanche are also slightly in the red from the larger-cap alts. Binance Coin, Shiba Inu, and Litecoin are among the few exceptions with insignificant gains. Dogecoin, however, stands out as today's top performer. DOGE is up by 8% as Elon Musk hinted that Twitter could soon integrate crypto payments.
